Chapter 19 Aftermarket Crash Parts Regulation Disclosure, Consent, Part Identification, and Equal Quality to OEM Parts Repair shop must disclose to the customer that the estimate was prepared based on the use of auto parts not made by the original manufacturer and that the parts used are required to be at least equal in like kind and quality in terms of fit and performance to the original parts. No insurer may require the use of any aftermarket part in the repair of an automobile which does not carry sufficient permanent identification so as to identify the manufacturer nor shall they require the use of aftermarket parts unless the customer is advised that the use of non-OEM parts is not required and if the customer consents in writing to the use of aftermarket parts.
