Title 11 Department of Banking and Insurance Division Of Insurance/ Chapter 2 Insurance Group/ Sub-chapter 17 Unfair Claims and Settlement Practices Disclosure, Part Identification, Equal in Quality to OEM Parts, and Certification If the insurer specifies the use of aftermarket parts the claimant must be notified that the estimate was prepared based on the use of automobile parts not made by the original manufacturer of the vehicle and that the parts used are required to be at least equal in like kind and quality in terms of fit, quality, and performance. Estimate must clearly identify all aftermarket parts installed on the vehicle. Aftermarket parts must be permanently marked with the manufacturer's indentification and must remain visible after installation. Aftermarket parts must be certified by an independent testing laboratory.
