CSR: Department of Insurance/ Division 100 - Division of Consumer Affairs/ Chapter 1 - Improper or Unfair Claims Settlement Practices ST: Chapter 407 Merchandising Practices/ Section 407.295 Disclosure, Part Identification, and Equal Quality to OEM Parts Repair shop must disclose to the customer that the estimate was prepared based on the use of one or more crash parts supplied by a source other than the manufacturer of the vehicle and that the warranties applicable to the replacement parts are provided by the part manufacturer. Also it must be stated that the aftermarket parts used in the repair are required to be at least equal in like kind and quality in terms of fit, quality and performance to the original manufacturer parts they are replacing. All aftermarket parts installed on the vehicle must be clearly identified on the repair statement. No insurer may require the use of aftermarket parts unless the part is at least equal in like kind and quality to the original part in terms of fit, quality and performance. All aftermarket parts used must have sufficient manufacturer identification and must be accessible to the extent possible after installation.
