Title 191 Insurance/ Chapter 15 Unfair Trade Practice/ Division 1 Sales Practices/Aftermarket Parts/Section 537.B.4 Disclosure, Part Identification, Equal in Quality to OEM Parts, and Certification Repair shop must disclose to the customer that the estimate was prepared based on the use of aftermarket crash parts supplied by a source other than the manufacturer of the motor vehicle and that the warranties applicable to the replacement parts are provided by the manufacturer of the parts. Any aftermarket part supplied for use must have affixed or inscribed on the part the logo or name of its manufacturer. A repair facility installing an aftermarket part must install it so that the manufacturer's logo or name is visible upon inspection whenever practicable. An insurer cannot require the use of aftermarket parts unless the aftermarket part is certified by a nationally recongnized entity to be at least equal in kind and quality to the original equipment manufacturer part in terms of fit, quality, and performance, or that the part complies with federal safety standards.
