ADC: Title 50: Insurance/ Chapter 1: Department of Insurance/ Part 919 Improper Claims Practice/ Section 919.80 Required Claim Practices - Private Passenger Automobile - Property and Casualty Companies ILCS: Chapter 215 Insurance/ Title Insurance Code/ Article IX: Provisions Applicable to All Companies/ Section 215 ILCS 5/155.29 Disclosure, Part Identification, and Equal in Quality to OEM Parts Repair shop must disclose to the customer that the estimate was prepared based on the use of crash parts supplied by a source other than the manufacturer of the motor vehicle and that the warranties applicable to the replacement parts are provided by the manufacturer of the parts. Any aftermarket part supplied by a non-original equipment manufacturer must have affixed to or inscribed on the part the logo or name of its manufacturer, such that it is visible after installation whenever practicable. No insurer may require the use of aftermarket crash parts unless the replacement part is at least equal in kind and quality to the original part in terms of fit, quality, and performance.
